I don't really follow the news, but isn't the US already literally at war? Not sure if they stopped bombing Yemen yet and will not be bothered to check, but I think to this day they're operating in Syria, Afghanistan, & Iraq

i believe they impose restrictions and privileges amongst belligerents and neutrals and there are some implications in re the mutual recognition of sovereignty

you could look back to the US Civil War, in which one major issue was the status of the South as a rebellion vs. a sovereign power if they became classified as the second, certain rules regarding the ability of foreign nations (esp England) to trade with them kicked in
