It depends on your jurisdiction. Water rights aren't a thing in the east, but a very much a thing in the west. Aridity is the driver. (Also, apparently why Israel kept the Golan Heights.)

kontextmaschine on Tumblr talked about this once, but in the West, land comes with rights to all the water it used when water rights were codified (not sure about alienability), so e.g. cisterns are illegal because the rain that falls on your land belongs to someone else.
