This law would functionally make it illegal for me to do my job in California. @LorenaSGonzalez please rethink this.

Sure. As an employment attorney who practices in California, AB 5 simply clarified who can and cannot be forced into an independent contractor relationship. Businesses can still hire employees on a short-term basis.

As an employee, long-term or short-term, you are entitled to be paid for all the hours you work, meal periods, rest periods, expense reimbursements, and indemnification from lawsuits. Plus worker’s comp, paid sick days, etc.

Compensation need not be hourly, but can also be piece-rate, commission-based, or even salaried. The key is that you get paid. And not in hopes and prayers, but paid in instruments that can be turned into cash on demand.

So, let’s say you submit 35 articles for a publication. At that point in time, the publication can still hire you for gigs, you are now protected by the Labor Code.
