Yep. For instance, the reason you couldn’t steal a dog was that very expensive dogs might be worth more than the amount required for grand larceny, or people might commit burglary to steal one, and those were felonies.

They were still property, they just couldn’t be stolen. You could probably have brought an action for trespass to chattels to recover it, but it wasn’t possible to steal one. It was a judicially created exception.

Jury nullification and work-arounds like this being children of the Bloody Code is probably a lesson in human nature.
