OSS maintainers CAN be sued AND MUST BE sued if they cause damage to others intentionally. OSS infers people contributing for the good of the community. ABC was paid by Jihan and tried to jam in some protocol changes. I get it. Normal play for this space. The checkpoints+exchange rig move, however, took this from a 'hash war' to a brand/ticker/network hijack.
Even without discussing bitcoin realm, I am not aware of ANY open source developer who’s secretly being paid by another company to write their “open source” code. No serious and ethical developer engages in this type of opaque and shady deal. All disclose their affiliation 100%
Not to mention how much impact this code has in other innocent people’s investments. Imagine the company behind ABCs funding was not bitmain/bitcoin.com but Bank of America. This would be the scandal of the decade and many would go to jail for market manipulation
