It was made by Maxis for Microsoft, so its source code is not his property. Raymond Chen wrote in his blog that they even can't release it to the public or repackage it as a stand-alone product. yeah, the source isn't owned by microsoft, but other things here are also not microsoft properties such as softpc, which is used for emulating dos programs on non-x86 windows versions
