Follow my reasoning here. Current law makes it illegal to expose oneself for sexual gratification in a public space. The proposed amendment would extend the law to make indecent exposure in public bathrooms illegal IF the person is using the facilities of the opposite sex.

A public restroom is already a public place, and the law is not changing the definition of indecent exposure. It would supply a defense for anyone exposing themselves who wasn't trans. "Hey, I flashed that kid, but it's legal because we're the same sex, see?"
