    Important lesson: the "miracle" is that I *helped* my survival by getting valid life-saving info thru the peer-to-peer channel, as describes perceptively in her 10-min video: Note: it was visionary PCP who referred me to them.

    . I could swear you recently posted about the levels of peer-to-peer, from just asking around for thoughts, on up to brilliant insights no professional could be expected to find - or some such. But I scanned your blog back to Nov & can't find it. Where/what?

    HIPAA’s coverage is not determined on a “per patient” basis. So if you engage in payment-related transactions for any patients, you are HIPAA covered - even for the uninsured or voluntary cash pay patients.

    Note though that has a lot of rules, not just keeping data private. It also includes a right to *access*, and I dunno what state regs say about this. btw, here's to all the docs I've had who have always been great about giving me copies, before & since HIPAA!

    At this point Medicare EDI (electronic billing) is required w few exceptions and many private payors are not far behind. So only a small minority of providers can escape HIPAA at this point - and they are (partly) covered by a tangled web of other laws.

    That’s 100% correct and always has been. I was a HIPAA privacy officer when it first started and it took a Herculean effort to convince pharma clients that they aren’t covered entities. People just use it as a catch all.

    Believe that’s why the law is written that way. With that in mind, requiring electronic billing seems odd and not necessary to let Congress regulate in this space. Plus HIPAA is old and electronic billing less common then. Unless added by ACA I am doubtful of this. 4/x

    I believe HIPAA has this threshold because Congress would need jurisdiction to regulate doctors and insurance companies to impose privacy restrictions on this data. 2/x

    He’s right hat HIPAA doesn’t offer general privacy protection on health care data. It’s tied to insurance billing. So doctors that don’t accept insurance are not subject to HIPAA. I’ve not heard any requirement about electronic billing. 1/x

    Because Congress only has authority in narrow areas under the Constitution (it reserves all powers to States unless otherwise specified) it has to find a jurisdictional hook. Most doctors don’t operate across state lines but most if not all health insurance companies do.

    Yes - only providers who bill payers using HIPAA standard transactions are covered by HIPAA.
