The problem with that is equating value. That 10 seconds might be more valuable than the rest of the 15 minutes combined. Music industry will bring that to court and you'll have to prove (impossibly) that your video is worth more than the song.
By that logic then there has to be an assumption that the song actually adds value to the video.
