        Hate speech isn’t protected speech. The First Amendment isn’t an open bar to order both speech and direct incitement to violence.

        Right, masquerading as speech isn’t protected. You’re just using a broad definition of hate speech to disagree.

        There is literally an exception by SCOTUS to a large category of hate speech, and tests to decide whether it incites violence.

        yes, but those exceptions aren't called hate speech. They're called ""incitement" and "true threats".
