Is it overreach if law enforcement is selective of the cases it takes to attract attention and send messages?

As in, I wasn't saying they are being malicious. Just that this looks similar to the
@Apple case. Waiting for a good example to splash on. -
@MalwareTechBlog is high profile enough that he can eventually "afford" real lawyers (probono or via donations) vs. most people in the scene -
Also, he is "innocent" enough to capture everyone's attention. I mean, I'm no expert but this seems like a well calculated strategic move.
