They absolutely can - but it's very dangerous. It's one thing if the person is voted in without the populace knowing of their true history, but it's entirely different if they know and vote despite it. Congress would be saying, "you chose wrong so your vote doesn't count."

A government body with the gall to do that is a danger to our democracy.
