The problem is that Congress is clueless about any of this like everything else

It’s a tough set of policies to get right in a highly functional legislative setting - which doesn’t exactly describe Congress now. But getting the basic principles right will help a lot. Also why states are perhaps better suited at the moment. No regulation is not an option.
