Birthright citizenship has been discussed by the Supreme Court twice. In one case the parents were citizens and in the other case the Court said in dicta (not in the decision per se) that birthright citizenship only applied where parents were citizens.

Prior cases will not matter. He will likely alter the rules of 'jurisdiction' n the Code of Federal Regulations. The 14th will then refer to his new definition. A SCOTUS case appears when current citizenship is challenged by the new rule and interpretation.
