It's almost as if they're using human rights abuses as a deterrent.
Supposing deterrants work (they don't, especially when someone is fleeing more certain death), this is still a human rights violation.
Even if it were illegal to seek asylum (which it obviously isn't), shouldn't it also be unconstitutional? The Eighth Amendment prohibition against "cruel and unusual punishment" comes to mind.
