If @realDonaldTrump and @senatemajldr ram thru a replacement now, the SCOTUS will have a majority of justices appointed by presidents who finished 2d in the popular vote, confirmed by senate majorities who represented less than half of the country.

Constitutions are capable of sucking quite severely, you know. It’s not an effective argument to just yell “Constitution!” if you can’t make a case for the rationality of the rules enabling extensive minority rule (the EC and apportionment of Senate seats).

Yup. I will never understand how anyone can defend the Electoral College in a modern America.

The states could solve this problem themselves by changing how they allocate their electoral votes. The Constitution does not say that a state must allocate all of its votes to a candidate who wins the popular vote in the state.
