in the sense that he's arguing from ideology, sure, a bit. I think his original concern was much more about what kind of laws ought to be permissible rather than anything to do with trans persons though.

in other words, it's almost purely ideological, not based on something that has happened, but in principle might happen. he objects to being arrested for declining to use a pronoun if he chooses to.
