      Drivers must convince us, in part via accident liability insurance, that we can trust them on road. Similarly, folks should convince us via crime insurance that can trust them in our stores & parks.       This entire proposal seems like it will have all the same problems that privatized health insurance has except it also empowers legislators to fuck with people's premiums by criminalizing new things. At least Congress can't invent new diseases.

          They already can and do criminalize things when they want to. Can't you imagine holding constant what is punished how much, and changing to more efficient ways to discourage crime?

          Maybe efficiency ought to be subordinate to other values, like limiting the ability of the powerful to harm the weak.

          I don't at all see how letting insurers price risk accurately helps the powerful to help the weak.

          Insurers have incentive to collude with Congress to adjust the criminal code in a way that maximixes to profits they collect from premiums. I don't see why they would try to accurately price risk when they can instead get Congress to feed them more money by criminalizing things.
