Sadly this includes a threshold of 3.5% effective for Germany only.
I fought hard against this! It steals votes from up to 10% of DE citizens (~5mio) and is anti-democratic!
I tried to get an exemption for all parties affiliated to EU parties, only got it if running in 7 MS

Agreement on new EU election rules
So, as I wrote below, we agreed on the political lines for a new electoral law act.
This is crucial - but still only the beginning. Next come votes in committee & plenary, before the countries butcher our draft.

many bigger countries have special rules, either national thresholds or such creating regional lists, which lower the minimum to get seats - only Romania could be affected as Germany, but they get only 33 seats nation wide in European Parliament -> this is already 3% as minimum
The threshold for DE only means that the German CDU-CSU guys have not understood the concept of transnational lists. They still think in terms of states not federal parties. The trilogue will have to sort out this nonsense.
The ECJ if invited to do so would knock this anomalous threshold out of court, I hope. @guyverhofstadt @DomenecD @svensimon

How would %thresholds for one country only work when the election is pan European?
Only 28 MEPs are going to be elected paneuropean. The other 705 MEPs will get elected on national level (as in the last EU elections).
