It turns out judges have had to answer some difficult questions about what counts as rape over the years. E.g. if an identical twin gets drunk and has sex (with consent) with his twin's girlfriend and she later finds out, is is rape? YES according to R. v Cringle (2010)
If a high school principal coerces a seventeen year old girl into giving him oral sex in exchange for a promise that she will graduate is that also rape? NO according to State v Thompson (1990)
