they only pay 1/2 of the price for the job (company will pay the remainder to the tutor) if not, they just pay full price which is their penalty for flunking w/ no reason xD (or rather, lack of reward)

It's legal, just not ethical. But school doesn't really measure anything, and real life is already unfairly balanced anyways. So I'm not sure if it matters.
