Technically, isn’t YouTube in violoation of that contract, since you and Audible both had good faith reasons to believe YouTube would never put ads on this video per their own policies regarding sponsored content? Might be time to get your sponsor involved...

Why is UMG reviewing the appeal? Why is not YouTube reviewing the appeal, and concluding that it is fair use, and fixing the problem?

Because fair use is not something that saves you from getting claimed, it’s just something you can use in court as a defense. YouTube doesn’t want to be the one to decide what is fair use Bec legally that’s not their job. I guess?

Fair use WAS created to protect people that discuss or parody something by using much of the source material, and just because it legally isn't YouTube's job doesn't mean that the result of a copyright dispute should be up to the claimant - as that's incredibly easy to abuse.

But the claimant does own the copyright so they either need to acknowledge it’s fair use or bring her to court and a judge will decide. I’m not really sure what YouTube can legally do here? Not saying YouTube isn’t super shitty in other ways...
