Some businesses claim that all code written by employees, in or out of the workplace, is their property. Does that mean that if the employee wrote malware on his/her own time, the employer could be held liable for any problems caused by "their" code?

I'm not a lawyer and don't play one on TV, but I doubt a company trying to "disclaim" something they previously said was theirs would shield them from a lawsuit.
