Because it may not be a hate crime? Same as other ‘hate’ crimes (race, religion) how to you determine that sex, religion, colour where the factors for the crime?

If you can prove that it was done out of homophobia, additionally charge them with a hate crime, if not, charge them with "just" murder, pretty straightforward

At the end of the day that’s what it is murder, it’s no different if hate towards a gay, colour, someone of same colour, religion....murder is murder and it should not be less or more if sex, colour or creed comes into it. You don’t murder someone because you love them..

The only difference between a crime and a "hate" crime is the added element of speech. As bad as these crimes are, heavier punishments for crimes based on that element of speech violates the 1st A.

ALL violent acts are hate crimes. Extra legislation doesn’t change that.

The idea is to add additional punishment. As much as I agree that these crimes are particularly heinous, the element that incurs that additional punishment is the element of free speech. Therefore "hatecrime" laws violate the 1st A.
