Maybe if they would've kept him in jail/taken his license after the 1st, or uh, 2nd DWI offence those innocent ppl would be alive/unharmed.

You're never allegedly guilty b/c it takes away presumption of innocence. Just b/c it is open shut case, you still use term until convicted.
