It IS a law, and they can’t sign an executive order against it. That’s why they included a provision (e) that they will file to change the Supreme Court ruling immediately in sec (e). If that fails, the EO is unenforceable. Liberal judges, your ball.

I'm sorry, but this is inaccurate. 1. Flores was a district court decision, not a Supreme Court decision. 2. Filing to change it isn't necessary to prevent children from being taken from their parents; it's necessary to keep families in detention past 20 days IF kids are present.

3. Gov't is angling for 20+ day detention given the reality of a severely overloaded immigration court system, but: 4. There is literally no law on the books that ever required the gov't to separate kids from parents. Policy decision dating to April 8th, 2018.

And 5. The system was overloaded already, but exploded after the April policy (Sessions directed criminal prosecution of migrants rather than exercising discretion). This is the government's tacit admission that it made things worse and that no solutions are on the horizon.
