[2/2] The reason my hat is permanently off to Tim and Epic is because, thanks to them fronting huge legal costs and losing a lot of short-term mobile revenue, we will now have a clear-cut case for the US courts to declare whether closed-hardware stores are or aren't "markets".

It is not a matter of whether Apple or Epic is "greedy", whether Apple is "right" or "wrong", or has a "right to control" their hardware, or any other what-you-think-should-happen opinion. It is a question of US and California law, because Apple is required to follow those laws.

Appreciate the reply, Casey. Big fan of yours. I agree with this, but pointing out that Apple doesn’t make games is about shaming Apple in a moral sense, not about establishing under the case law whether iOS is a market or not.

It is not shaming, it is trying to demonstrate that although Apple is not a gaming company, their monopoly position (if they are found to have one) allows them to extract an enormous tax on game developers. It is directly related to the anti-trust claims.

I'm curious what is your opinion on how these applies to the console market. Does the context change if the hardware is produced at a loss ? (ex: PS and Xbox)

Just to reiterate: none of this is about opinions. This is a matter of US (and California) law, and only courts decide what are and aren't markets by considering their mandates under the acts that the legislature has passed.
