I have never heard an outcry about public safety for the thousands of people who are released on bail every year with the help of a bondsman because they can’t afford bail. Release those same people without bail, and they’re a threat to public safety. /3

Am I right in thinking that only failing to appear forfeits your bail money - that committing crimes prior to appearance doesn't affect it? In other words, a cash bail is no extra disincentive to crime?

There is a distinction between “public safety” and “crime prevention.” To relate bail to considerations of “public safety” is to raise the question of who can afford to be a threat to public safety while completing criminal court proceedings. /1

This is not about public safety. Perceptually, bail is a punitive measure and to be released without bail is to escape the first phase of punishment. Just think, if everyone not detained on bail under the new reform would’ve been released after paying bail, would be no outcry. /4

A billionaire would never be given a bail of 1.2 billion dollars to ensure they’re not a threat to public safety. But it is common place to see low income people getting bails of 20 to 30k and then be allowed to use a bondsman to achieve release. /2
