Under the Vacancies Reform Act, Wilkie will have to step down as acting VA secretary once he is formally nominated to be VA secretary. See: http://www.scotusblog.com/case-files/cases/national-labor-relations-board-v-sw-general-inc/ …pic.twitter.com/xiphBqPI6r

Meanwhile, at DOD, there's still no principal deputy in place under Wilkie. That's the person who would be "delegated full power and authority to act for" Wilkie, as consistent with law. The position is vacant. It does not appear Trump has yet even nominated anyone for the role.pic.twitter.com/64noYq8STL

(The last nominee I can find was from Obama in 2014, but someone should please correct me if I'm wrong. Also: DOD should correct its spelling of "Readinesss" in the principal deputy's job title there.)

And, we got an "intent to nominate" release about Wilkie, who Trump said earlier today was his pick to be VA secretary. Wilkie will have to step down as acting VA sec when formally nominated (see earlier in this thread).pic.twitter.com/fJPPgO5UHw

Wilkie must step down as Acting VA Secretary while his nomination is pending, pursuant to the Supreme Court's interpretation of the Vacancies Reform Act in NLRB v. SW General.
