If it's true that either a president can't be indicted or any indictment must wait for the president to no longer be president, then the American experiment will fail.

Well, then DOJ for the past four decades has decided the American experiment should fail.
-
Yep. It’s the definition of an imperial presidency, above and beyond the law.

If a president was elected by a foreign power he does not represent or adhere to the Constitution therefore he can and should be indicted.

The most extreme hypotheticals - i.e. knocking off members of Congress that might impeach him - make it obvious that a sitting president should be indictable. If Trump was actually killing folk should we have to wait for Congress to impeach? It's a stupid hypo but still
-
Presidents kill people all the time. Do you mean personally stabbing someone instead of calling in a drone strike?
-
Yes. If he stabbed Melania for laughing at his hands he could or surely should be indicted. Or, as I was thinking, if he started killing all members of Congress that were bent on impeachment indictment should be possible. The Infallible Framers certainly didn't want a monarch.
-
agreed just wanted to point out that it depends on *the kinds* of people the president is killing

If you indict while the pres is sitting, might there be speedy trial issues? In any event, can’t see the Court permitting prosecution for reasons similar to civil actions. Yeah, criminal is different, but impeachment is only way to remove. Impeach or indict after term.

General anti-monarchy principle: the Framers were fighting against an executive who was above the law. They did not create a system of government where the executive is above the law.
