Not necessarily. Some lawyers work pro bono in certain cases. But there certainly has to persuasive evidence of an an attorney-client relationship - usually in the form of a written contract. You can't just ask for attorney client privilege.

Because if you come to me with a legal question specific to your situation and I give you information and advice... And then you don't hire me, it's still a privileged communication.

If that's true, that basically creates a situation where an attorney can never be called to witness in any situation. If any conversation/encounter they ever have--regardless of whether or not they were acting as counsel--can be cited as privileged...

In that case, someone could start copying any random attorney on every text message and email they send and claim it was privileged. Ludicrous. There should have to be a formalized, established relationship where services are offered and retained for the privilege to be invoked.
