      In New York, you can appeal as of right to the Appellate Division from the trial court's refusal to grant a motion to dismiss. That would not be true in federal court, where you would have to get special permissions to appeal. 2/

      However, just because you can take interlocutory appeal doesn't mean you get much benefit from it. That's because trial court proceedings aren't automatically stayed for appeal, which might not be heard for awhile. You have to move for a stay, which becomes very important. 3/

      So for those following case, the next thing to watch for is stay litigation. That can be, um, informal. Sometimes it's two lawyers agreeing to show up at courthouse at given time with set of papers and handing them to judge (or even clerk!) to look over for a few minutes. 4/

          Yup. That's the trial court's determination on the stay. The Appellate Division will surely be asked to weigh in!
