From way back during the campaign, here was my and
@RosieGray's reporting on the NDA that — of all people — Sam Nunberg signed with Trump:https://www.buzzfeed.com/chrisgeidner/here-is-the-confidentiality-agreement-signed-by-a-former-tru?utm_term=.ollq9lNzO#.ycrobKPM7 …Show this thread -
This past September, meanwhile, I reported on ongoing White House efforts to address leaks — by reporting on a leaked anti-leaking memo.https://www.buzzfeed.com/chrisgeidner/trump-administration-launches-broad-new-anti-leak-program?utm_term=.ni4BN4JoX#.cdpLObXrg …

Anyway, the point being, if you've signed one of these or seen one, you should talk with me. Thanks.

As Ruth's story makes clear: These are almost certainly unenforceable. That doesn't mean they don't have a chilling effect on staffers/former staffers who might not want to deal with the threat of a lawsuit, even if it might ultimately come out in their favor.

And, obviously, the fact that they're almost certainly unenforceable is a separate question from whether they're appropriate.

Walter Shaub, former OGE head, goes into more about all this in this thread — with some very interesting legal questions — and this conclusion: "I keep thinking they can't surprise me any more or sink any lower, but they keep finding new ways to surprise and sink lower." https://twitter.com/waltshaub/status/975474532562718721 …

This tweet from Michael Hayden makes me think of another point. This is yet another story in which Don McGahn's White House Counsel's Office played a key role in a questionable-at-best decision, per
@RuthMarcus' reporting,https://twitter.com/GenMhayden/status/975499864749625344 …Show this thread

Have a feeling that most facing a Mueller subpoena won't be too concerned about a Trump NDA.
-
I mean, obviously not. I'm not sure your point?
-
No, great line of pursuit, very interested in what you discover. Just highlighting how Trump has gotten himself into a mess that NDAs can't fix.
-
Oh, definitely yes on that front.

You are replying with a tweet linking to the same story. As Kyle's tweet even states, Ruth's story is based on a draft NDA. Hence, my asking for a signed one.

Unenforceable NDA,which court/judge will grant such a request? The government is not private property of Donald J. Trump! Assuming there’s a judgment to such nonsense, who gets the money ($10m) awarded?Well a con man will want to pocket it.Trump has lost all rationality of a being!
Thanks. Twitter will use this to make your timeline better. UndoUndo

If we're speaking of federal employees...whether they work in the WH or for anyone in Congress, how is it legal that they be required to sign a NDA ?
-
newsflash...it isn't
