The most fascinating argument is that it discriminates against women!pic.twitter.com/FNlZqj7mKv
Women in *all* age cohorts commit far fewer crimes than men. I wonder what other generally applicable laws are secretly discriminating against women!
It's like a reverse Craig v Boren--the Constitution requires treating 18 yr old women as more responsible than 18 yr old men!
Are there other constitutional rights that can be limited like this for 18-20 year olds? A narrowly tailored ban on certain types of firearms might well survive under the Heller regime. But banning all guns for 18-20 yr olds seems unlikely to be upheld.
I may be too conspiratorial, but I wonder if perhaps NRA was happy that FL passed a total 18-20 ban because it would be easier to invalidate than a narrower ban on assault rifles or something.
Doesn't federal law ban purchases of handguns by the same group? Unless NRA is taking on that, too, it'll be interesting to have them in effect say handguns are more dangerous than long guns.
Hmm — looks like restrictions on gun rights for 18-20 year olds are a lot more common that I had thought, and the new FL law is not unique.http://lawcenter.giffords.org/gun-laws/policy-areas/who-can-have-a-gun/minimum-age/#federal …
I looked into it a few weeks ago...https://twitter.com/KDbyProxy/status/964123530702057472 …
Idk about this. Quick look at the Illinois code seems to allows for <21 (no convictions) w/ written parental/guardian consent. See § 4(a)(2)(i) http://www.ilga.gov/legislation/ilcs/ilcs3.asp?ActID=1657&ChapterID=39 …
As noted, the info I used was from giffords-dot-org. In any event, seems eg a 20-year-old whose parents wouldn't provide approval would be a potential plaintiff from the NRA's POV.
Thank you for the link. I think I am going to have my litigation students assume they work for Bondi's office and draft a production demand to the NRA to see what they come up with for a complaint this vague on arguments.
Do people (the nra in this case) not realize ALL laws are changeable. It is called the second AMENDMENT for a reason. Nothing is written in stone.
I think they have the same lawyers as trump!
Am I right they are using this to overturn laws that apply even to handgun purchases? It does say "of any kind."
I don’t know. I think it has some logical appeal. If a person is of the age of majority in a state, can the state deny him some of the (arguable) constitutional rights afforded to all adults, just based on age? Could FL say only ppl between 30 and 50 can buy these guns??
Um, they can’t drink until 21.
Well if this argument does succeed, say hello to nationwide drinking age of 18.
