It is a two-box day. Opinions in 5 minutes. #SCOTUS
The first decision is in Merit Management Group v. FTI Consulting. Unanimous opinion is by Sotomayor, affirming the 7th Circuit. #SCOTUS
Here is the Merit Management decision: https://www.supremecourt.gov/opinions/17pdf/16-784_gdhk.pdf … #SCOTUS
Second opinion is Jennings v. Rodriguez, one of the reargued cases. Alito writes for the court, reversing the 9th Circuit and holding there is no statutory right to bond hearings for the affected undocumented immigrants. #SCOTUS
Alito is joined by Roberts and Kennedy in full, Thomas and Gorsuch in large part. Breyer dissents, joined by Ginsburg and Sotomayor. Kagan had recused herself. #SCOTUS
After Alito read from the opinion, Breyer is reading from his dissent from the bench. Here is the opinion in Jennings: https://www.supremecourt.gov/opinions/17pdf/15-1204_f29g.pdf … #SCOTUS
Breyer's 33-page dissent is two pages longer than Alito's 31-page opinion. Breyer is still speaking.
The final decision for today is Patchak v. Zinke. There is no majority opinion. Thomas "announced the judgment," joined by Breyer, Alito, & Kagan, affirming the DC Circuit. Breyer, Ginsburg, & Sotomayor write concurring opinions. Roberts dissents, joined by Kennedy & Gorsuch.
