The SOTUS decision not to hear the DACA challenge now is a victory for DACA's supporters, as the move — at least for now — likely will keep the injunction, allowing DACA renewals to continue, in place for a while.

It had been an uphill request from DOJ. The court rarely hears cases before the appeals courts have had a chance to weigh in, but DOJ had argued the issue was important enough to do so.

It also, however, looked like a pretty brazen attempt to skip the 9th Circuit — which has been critical of several Trump moves — and the Supreme Court, effectively, told them to go back to the 9th Circuit first.

After all that, Justice Gorsuch — the only new member of the bench since the Friedrichs arguments over public union agency fees more than 2 years ago — said nothing at this morning’s Janus arguments.

Trump on SCOTUS not taking up DACA challenge appeal now: “We'll see what happens. That's my attitude," per pool. Also, per pool, Trump ridiculed the 9th Circuit, saying "nothing" is as bad as the 9th Circuit.
