Alabama is now set to execute a 61-year old with cancer who lacks accessible veins in his arms by a means "never ... tried before in Alabama." This man was sentenced to death for a 1987 murder on a jury's 11-1 recommendation.
Eric Branch, executed in Florida tonight, died at 7:05 p.m. He was sentenced to death on a 10-2 jury recommendation for a 1993 rape and murder. http://www.orlandosentinel.com/news/os-florida-execution-eric-scott-branch-0222-story.html …pic.twitter.com/wMwKl2fQ2U
Clarification: Breyer's opinion in Doyle Hamm's case is not styled as a dissent. It is a statement "respecting the denial" of the stay and cert petition. And yet, it concludes by stating, "I would reconsider the constitutionality of the death penalty itself." (h/t @joshindenver)
As such, there are, technically, only two noted dissents to Hamm's stay request.
Here is the Dunn v. Madison concurrence to which Breyer refers:https://supreme.justia.com/cases/federal/us/583/17-193/concur4.html …
Note that both executions proceeding tonight resulted from death sentences reached by non-unanimous jury recommendations.
Update on Doyle Hamm's scheduled Alabama execution. Media witness @JackRoyer reports that the witnesses are still waiting in vans outside the building housing the execution chamber. https://twitter.com/JackRoyer/status/966890323765964802 …
In all, only one of the three executions that were slated to go ahead across the US at the beginning of the day had been carried out by the end of it.
Note: More than 2.5 hours passed between the time the US Supreme Court lifted its temporary stay and the time the state called off the execution. So, I’m not quite sure I understand this explanation, unless there were issues —> https://twitter.com/jackroyer/status/966909618214416386 …

The Alabama Corrections head, Jeff Dunn, came out to speak without having spoken with medical personnel, so he basically couldn’t explain anything about what happened with Doyle Hamm from 9p to 11:30p CT. (Thanks much for live-streaming, @JackRoyer.)pic.twitter.com/gcQbbVpAZO
This was Justice Ginsburg’s dissenting opinion earlier tonight, explaining why she and Justice Sotomayor would have granted a stay of execution to Hamm.pic.twitter.com/5UWRDdSV8a
Wow, justice kegan is pro death penalty.
Easy answer take him out back and stand him before a firing squad, bullets don’t need beautiful veins!
Cant wait for Breyer to retire. He's trying singlehandidly to stop the death penalty despite 300 yrs of jurisprudence. #Shame #Liberalismisamentaldisorder #SCOTUS #KILLthekILLERS @Seanhannity @loudobbs @Maddow
More killing, more death.
So they are going to allow the state to try a new method, never tried before, of taking the Defendants life?
