To tee this up for a decision (and potential higher-court review), Judge Kollar-Kotelly has ordered DOJ to file a motion seeking to stop discovery the dep't asserts is barred by the presidential communications privilege by Feb. 27 — with response and reply to follow in March.
Additionally, although they were submitted to the court (and each other) on Feb. 12, the court made public the letters detailing the executive privilege discovery dispute this afternoon.
