Well, I don't think the court will see the questions are the same. Fundamentally they are making two separate claims and asking for the same relief. That's not the same as sharing a common question. Also, I think/would argue "Freedom Watch" lacks standing to bring the case.
This is subject to the well known rule that if you can't even ask for your motion to be granted without a typo, it's denied automatically.
