Perhaps Roberts is moderating in response to the injustice of Gorsuch being sat, as opposed to 0bama's choice. While SCOTUS had no choice in it, they had to see the injustice of the process.
I sincerely doubt that. There was absolutely nothing “injust” about the Gorsuch seating. The Senate simply followed the “Biden Rule” precedent.
