I had considered the record request an ~arguable~ re-start of the consideration of the case if, perhaps, they were interested in a particular issue (like Q.1), but, at this point, I'd say we are ~likely~ looking at someone writing a dissent to (most likely) a denial of cert.

Always a ~very slight chance~ it's a dissent to a summary reversal — a good way to avoid the case and change the circumstances for Hidalgo — but that seems less likely here than a dissent (or dissents) from a denial of cert.

I wouldn't be surprised to see both a dissent and a concurrence (criticizing the dissent) from denial of cert in a case such as this one.
