The actual facts here: Sessions has authorized seeking capital punishment in two cases. ... We know Jeff Sessions loves the death penalty, but I feel like this story is just letting DOJ tell the "tough on crime" story it wants to tell.

As important as the new prosecutions is the issue mentioned almost as an aside in the article: The review of the protocol means there are no executions scheduled. So far as we know, the fed gov't has no execution drugs on hand either.

For context: There have only been 3 federal executions in the modern era of the death penalty. There are more than 60 people on federal death row.

Anyway, it seems a bit odd to raise the issue of the executions themselves but not delve into that side of things when writing a story with DOJ claiming it's somehow reinvigorating the federal death penalty by ~possibly~ authorizing more prosecutions.

This headline is kind of misleading — other than kingpin or treason statutes, only violent crimes can result in the death penalty. The headline makes it seem like the DOJ is being more discerning by only pursuing it for violent crimes.

I don’t think that’s how that is most obviously read — but, OK. (I have many other complaints, which I detail if you follow the thread.)
-
I think that’s more of the story just freely (inadvertently or not) advancing Sessions’ aim of showing he’s tough on violent crime.

Yeah I completely agree

Okay but the state's control state crimes. If someone is charged by the Feds and goes to prison in so many ways it's a death sentence.
