Why isn’t a violation of the emoluments clause in and of itself an injury? The framers of the Constitution were concerned with foreign influence, not individual standing to sue. Who else could sue for violation if not “competitors”?
Germans thought their democracy and robust institutions would save them from facism. Institution won’t save us from facism, whether it’s the Congress, judiciary or our election system.
