      "Performance measures" could lead to an interesting discussion about whether we should be concerned about the "roulette" among IJs -- that IJs are idiosyncratic on high stakes issues, some granting at high rates, some denying almost all asylum apps, bonds, etc. 5/x

      But the thrust of the memo is about mere completion of cases, not about inconsistency or quality. It focuses on delayed adjudication, while falsely blaming immigrants and their lawyers for this problem. 6/x

      HOWEVER: Mere delay, or even attorney work time, is not the reason for many continuances. The illogic of immigration adjudication leads IJs to give continuances to make sure all issues are explored. 9/x

      Basic problem is that IJs know that many immigration benefits must be adjudicated by USCIS, not by the Immigration Court. USCIS is extremely slow to process cases; IJs give continuances to wait for their decision. 10/x

      The alternative would be to order someone deported while knowing that s/he is probably actually eligible to stay in the country. That's wasteful of court time, illogical and inequitable. But that seems to be what Sessions wants. 11/x

      In sum, IJs are often trying to make the illogical and disjointed immigration system work so as to ensure all issues are considered before a person is deported. Sessions wants to strip them of the ability to do that 12/x.

          In light of what he has said before, I think he’s saying IJs should not make certain kinds of pro-immigrant decisions, on a number of issues. And the AG is planning to give directives and precedent decisions that are likely to be anti-immigrant.
