First take: The justices (at least a majority) were uncomfortable with a federal law that goes out of its way to say what a state can’t do, while setting up no regulatory system of its own.

The response from NCAA side and SG’s Office was basically that federal law already criminalized by way of reference to state prohibitions — but that ultimately seemed to reinforce NJ’s side to the majority.

Could you put that in English? Does that qualify him to argue in front of the Court, or has he been elevated to some kind of federal court position? Thanks for your coverage!

Means he can argue. That’s all.

It also means he gets access to a special entrance, line, and seating at arguments (separate from the riffraff), which is why a lot of attorneys like to have it.

I mean, I don’t really think he did it for any of those reasons, though. I think it was mainly a chance to get a little more of a show out of the day.

It's common practice for clients with cases at the Court to do it while they're in town, for the pomp but also because it's for life. I've had several. They're more likely to use the seating benefit, obviously.

Also, it certainly doesn't apply to Christie, but often clients or lesser team attorneys will do it for the seating that day, as each party is allocated only a small set of reserved seats.
