First take: The justices (at least a majority) were uncomfortable with a federal law that goes out of its way to say what a state can’t do, while setting up no regulatory system of its own.

The response from NCAA side and SG’s Office was basically that federal law already criminalized by way of reference to state prohibitions — but that ultimately seemed to reinforce NJ’s side to the majority.
