Flynn charged only with low-level 1001 count may have to do (in part) with pardons-- if Trump pardons him (or Flynn fails to follow through on the deal) there are lots of charges to come back with. @jessewegman @matthewamiller @chrisgeidner

Yes-- but that would require Trump to expend more political capital.

And the president can't pardon state offenses. 1001 is uniquely federal, but if there are other charges that could be brought under state law (e.g. fraud), there is no availability of a presidential pardon for those.
-
Right-- and it looks like Mueller has been working with state authorities.

That misses point, NY double jeopardy applies to Fed trials & pleas. Since campaign & transition run out of NY, Mueller & Schneiderman will have a lot of overlap. I think they’re assuming a general pardon inbound, paradox is: the less Mueller charges, the more leverage on Flynn.

Also, if they come back with more charges after pardon, wouldn't be have to pardon him a second time?

That’s exactly what will happen. He will just do a Ford-Nixon style of pardon (all crimes committed between x and y dates). Trump has absolutely no concerns about political capital. That’s laughable.

Potus can't pardon state crimes. There's probably one to charge him with if DJT tries to do that.
