The 9th circuit ruled in early Sept on the refugee changes, right? Only after that did DOJ ask AMK for relief.

Nope. They had started up there. Then SCOTUS sent it back to the Ninth, which held args at the end of Aug, then it went by to SCOTUS.

But, the first time they went up was when SCOTUS blocked Watson's refugee changes from going into effect while the 9th Cir heard the merits.
