This is accepting the premise of Sessions et al. without even explaining the counter-argument (the EEOC’s & growing # of courts’ position).
Their argument is, in brief, that sexual orientation & gender identity discrimination are, inherently, TYPES of sex discrimination.
Anyway, there are other issues with the NYT story and its framing, but the Title VII/Title IX issue is a ~speciality~ of mine, so, yeah.
