Presumptions are rebuttable (specifically for scenarios like that, in fact).

But my point is that a man that is not the biological father of a child is not considered the father via marriage unless he adopts the child

Or am I wrong about the law on that? If not, it appears gay marriages are being given more potency than traditional heterosexual ones.

Why? It's in the best interests of the child that it have as many presumed parents as possible for financial and other support.

I'm always skeptical of assumptions and presumptions, especially when government is involved. Easier to be willing parent? Great. Forced?

I think you'd have to look at the deep underpinning of the law, which was part of English common law we adopted at Independence.

Very sound reasons for it in a time when there was no way to determine biological parentage. Might be things are different now -- or not.
